| 6400.195(a) | Individual #1 had a restrictive procedure that was in place that was not reviewed and approved by the Human Rights Team Prior to use of the Restrictive procedure. Specifically personal belongings of Individual, to include Cigarettes and a Lighter, were locked in the program office due to previous behavioral issues. | For each individual for whom a restrictive procedure may be used, the individual plan shall include a component addressing behavior support that is reviewed and approved by the human rights team in § 6400.194 (relating to human rights team), prior to use of a restrictive procedures. | Staff and supervisor immediately removed the cigarettes and lighter from the locked staff office. The cigarettes and lighter is now located in the kitchen where Individual #1 can get them at any time. This was an oversight as these supplies were always stored in the staff office in his prior residence; however, the staff office was not locked. Also it was an oversight as they seem to have quit smoking since they have had some health setbacks. |
