The agency obtained a prescription for the grab bar on 03/21/2024 after the violation was discovered by licensing. Individual #1's most current assessment, completed 05/12/2023, does not indicate the need for the device, whether or not the individual can easily remove the device, if the device is removed by a staff person immediately upon the request or indication by the individual, or if the individual plan includes periodic relief of the device to allow freedom of movement.A mechanical restraint, defined as a device that restricts the movement or function of an individual or portion of an individual's body. A mechanical restraint includes a geriatric chair, a bedrail that restricts the movement or function of the individual, handcuffs, anklets, wristlets, camisole, helmet with fasteners, muffs and mitts with fasteners, restraint vest, waist strap, head strap, restraint board, restraining sheet, chest restraint and other similar devices. A mechanical restraint does not include the use of a seat belt during movement or transportation. A mechanical restraint does not include a device prescribed by a health care practitioner for the following use or event: Protection from injury during a seizure or other medical condition, if the individual can easily remove the device or if the device is removed by a staff person immediately upon the request or indication by the individual, and if the individual plan includes periodic relief of the device to allow freedom of movement.The individual¿s program specialist created an addendum to the current assessment (dated 3/27/24) (see emailed document #12) that includes the following: safety reason(s) for the use of the upper grab bar per physician¿s order and the individual¿s ability to freely remove the device if, and when, he chooses to do so. The individual¿s plan team (program specialist, behavior specialist, and supports coordinator) met with the individual on 3/28/24 to discuss revisions to the ISP to include the use of the grab bar for safety purposes to assist the individual in elevating from his bed to a standing position as ordered by the individual¿s PCP, as well as, to include information that the individual has the ability to remove the device on his own at any time if he so chooses. The individual¿s ISP was updated on 3/28/24 (see emailed document #13) to include this required information. 03/28/2024 Implemented
