6400.22(c)On 11/20/16, Individual #1 sold his Playstation 4 video game console to the adult son of Staff #1 for $30, which is significantly less than its actual value. (Through online research, it was determined a used PS4 normally sells for approximately $200.) Staff interviews indicate that Individual #1 was seen leaving the home with the Playstation 4 console. When Individual #1 was questioned about where he was going, he stated, "Don't worry about it." When staff told Individual #1 that he could not sell that item, Individual #1 replied' "You'll see." and continued out the door. Staff witnessed Individual #1 go to the end of the driveway. A car arrived at the home, but staff could not see what was occuring because Individual #1 and the car were obscured by trees and shed. Staff "turned their backs for a second" and then Individual #1 returned to the home without the Playstation. Individual #1 stated he had sold his PS4 for $30 to the son of Staff #1. Individual #1's ISP states that he will sell his personal items for well below market value and can easily be taken advantage of in this regard. Staff failed to provide the proper assistance to Individual #1 to adequately protect him from financial exploitation when they allowed him to take his PS4 from the home to an obscured area with the intent of selling the item.Individual funds and property shall be used for the individual's benefit. Individual #1 owned a PS4 that he wanted to sell in order to purchase a Christmas gift for his girlfriend. Following a private phone call in his room Direct Care Workers on shift attempted to talk with Individual #1 about not selling his PS4 however he ignored their feedback which resulted in individual #1 selling his PS4 for under market value. Following the sale of the PS4 an investigation was launched to determine if staff #1 was involved in the selling of the PS4 to her son. Individual #1 ISP was updated to include information from his support plan that was developed. Staff were trained on his support plan December 12, 2016. Individual #1 has wanted to sell items since the incident. Staff have supported this by taking him to the local pawn shop where he would receive fair market value. Staff #1 is no longer working in the community home where individual #1 resides. 12/31/2016 Implemented
6400.33(a)On 11/20/16, Individual #1 sold his Playstation 4 video game console to the adult son of Staff #1 for $30. Individual interviews state that Individual #1 offered to sell his Playstation 4 to Staff #1's son on 11/19/16. Staff #1 gave Individual #1 her son's phone number and instructed Individual #1 to not tell the other staff in the home. Individual #1 does not understand the value of his personal items and it is noted in his ISP that he will sell his items for much less than market value and can easily be taken advantage of in this regard. A new PS4 has been determined as having a resale value of approximately $200. An individual may not be neglected, abused, mistreated or subjected to corporal punishment. An investigation ensued following the incident (#8249124). Futures Community Support Services, Inc. investigation was unable to determine with any level of certainty that Staff #1 facilitated the sale of the PS4 by providing Individual #1 with her son¿s telephone number. There were no direct witnesses to exchanging of the phone number. Following the incident staff #1 was offered another position at another location where she would not work alone with an individual. Staff #1 declined the offer and stepped down to a substitute direct care worker with the restrictions that she could not work alone with an individual.
