| 6500.23(a) | It cannot be determined that criminal history checks for all caregivers and other house residents that were brought into the agency between January 2020 and the time of inspection have been kept in agency records. Records were missing for staff 1,2,3,4 and 5. | An application for a Pennsylvania criminal history record check shall be submitted to the State Police for individuals 18 years of age or older who reside in the home, prior to an individual living or receiving respite care in the home. | Shared Support South (SSS) follows a strict policy for running Criminal History Records on all employees, contractors and individuals living with contractors (see attachment "Employee Handbook - Background Checks"). SSS Criminal History Records have historically been run through Pennsylvania Access To Criminal History Checks (PATCH). PATCH system changed the process in which Criminal History Records are distributed to requester. Criminal History Records are no longer mailed and now fall on the responsibility of the requestor to print the No record or Record response (see attachment "PATCH System Change Notice"). Due to a change in system, the following Criminal History Records (while documented that they were completed) were not printed to be stored in employee file. SSS had documented Criminal History Checks were completed and stored receipt of Criminal History Check in records. Receipt of Criminal History Checks were presented at the time of licensing (see attachment "Criminal History Records and Receipts"). SSS contacted PATCH to retrieve records using Criminal History Check Control Number on receipt and was informed that records are purged/ no longer available for viewing following 365 days after Date of Request. |
