6400.32(h)The Department's expectation is that if a Provider is utilizing cameras in public/common areas, all individuals should be notified of the cameras, their locations, and the fact that they are recording. A signed statement should be obtained from everyone acknowledging their knowledge of the cameras. There should be a policy around what the cameras are needed for and state who can see that video footage. At no time should any program be recording audio. That is illegal per the Pennsylvania Wiretapping and Electronic Surveillance Control Act (WESCA)." The home is currently utilizing cameras to record in common areas of the home including the kitchen, main living area and the staff office. The Provider uses a form titled "acknowledgement of cameras in the home" which is signed by the individuals after reviewing the placement of cameras in the home and placed in the individual's record. Individual #1 did not have the signed form in their record and the provider stated that the individual had expressed that they did not want to be recorded by cameras in the home.An individual has the right to privacy of person and possessions.Individual signed the camera acknowledgement form after the wording on the form was updated. 08/28/2025 Implemented
