6400.112(d) | According to the submitted written record, for all fire drills conducted between 11/11/23 and 10/04/24, Individual #1 was not evacuated, but was protected in place within the home. No waiver of regulation from the Department was obtained. [Repeated Violation-10/31/23, et al] | Individuals shall be able to evacuate the entire building, or to a fire safe area designated in writing within the past year by a fire safety expert, within 2 1/2 minutes or within the period of time specified in writing within the past year by a fire safety expert. The fire safety expert may not be an employe of the home or agency. Staff assistance shall be provided to an individual only if staff persons are always present at the home while the individual is at the home. | Individual can not use stairs. Individual utilizes a walker, but mostly self-propels using a wheelchair. Individual enters and leaves his home using a stair glide to the basement garage. He can then enter the van or exit the garage via wheelchair. Over the past year, Individual has not evacuated during fire drills, but would use this method in case of an actual fire. A waiver of regulation 6400.112(f) -¿ Alternate exit routes shall be used during fire drills¿ will be requested, so that JA may participate in monthly fire drills using the garage as the approved exit for evacuation. The garage door can be opened manually and opens to ground level. The stair glide has a battery back-up. JA was successful in participating in the fire drill conducted on 11/6/24 using this exit. Individual will continue to participate in monthly fire drills. The Associate Director will submit the request for the waiver of regulation 6400.112(f) by 11/15/24. |
