A mechanical restraint does not include a device prescribed by a health care practitioner for the following use or event: Protection from injury during a seizure or other medical condition, if the individual can easily remove the device or if the device is removed by a staff person immediately upon the request or indication by the individual, and if the individual plan includes periodic relief of the device to allow freedom of movement.Individual #2 was given a physician¿s order for the use of a hospital bed with side rails for safety and protection from injury, secondary to their diagnoses of cerebral palsy and seizure disorder. The camera pointed to the individual's bed in his/her bedroom.(e) An individual has the right to privacy in bedrooms, bathrooms and during personal care. McGuire Memorial is applying for a waiver for the issue of the video monitor in the bedroom of -- which is used to monitor the individual for silent SIB behaviors while in bed at night, to ensure his/her health and safety while s/he is in his/her room. -- has his/her own bedroom and therefore the use of the monitor does not affect anyone else. Currently consents for the use of the video monitor was obtained by the human rights committee and the parents/guardians of --. In the event that the waiver is disapproved, McGuire Memorial will look at alternative methods for monitoring -- at night which may include a devices that monitors sound and does not give a visual picture, or requesting Additional Individualized staffing at night to ensure his safety while -- is in bed sleeping. This staff would be one on one and responsible to watch the individual while his is sleeping in order to immediately intervene in the event of an episode of SIB that could result in injury to --. All staff will be in-serviced that video monitors are not to be used in the bedroom areas.
