| Point of Caring, Inc. was in violation of 55 PA Code Chapter 6400.15(a), by failing to ensure that a self-assessment was fully completed for a home that the agency operates. This violation occurred due to human error on the part of the CEO, who was completing the self-assessment while attending to other work-related responsibilities. In order to avoid future violations of 55 PA Code Chapter 6400.15(a), the Program Specialist will attend to the important task of completing the self-assessments following additional training on 55 PA Code Chapter 6400.15(a), detailing the importance of proper and complete self-assessments of the agency and site compliance. |

| 6400.32(h) | During the on-site Renewal Inspection conducted on 1/4/24, cameras capturing video feed were observed in all common areas of the home, including the finished attic serving as an activity room. However, the agency did not acquire the consent of the individuals and/or their legal guardians to have cameras in the home. | An individual has the right to privacy of person and possessions. | Point of Caring, Inc. was in violation of 55 PA code 6400.32(h), by failing to provide proof of consent to have cameras in the home from the individuals residing in the home. This violation occurred due to failure to provide the signed consents within the individuals¿ records when the licensing agent questioned the presence of the consents. It is important for Point of Caring, Inc. to ensure all information is filed appropriately and provided to the licensing agents during the on-site inspection, in order to prove compliance with the Regulatory Compliance Guide.
Point of Caring, Inc. provided additional training for the Program Specialist regarding the importance of providing the necessary documentation needed to prove continued compliance with the Regulatory Compliance Guide. Additionally, Point of Caring, Inc. discussed the presence of the cameras in the home as well as the cost/benefit of maintaining the cameras in the home and has opted to remove the cameras. The cameras were removed as of January 10, 2024. |
