| 6400.34(a) | The provider's Statement of Individual Rights did not contain all of the rights in the Individual Rights sections (6400.31 -- 6400.33) of the regulations and, therefore, could not explain all the rights and the process to report any rights violation to individual #1. Specifically, albeit not solely, section 6400.32 (k) was missing from the document and included the language "[a]n individual has the right to participate in the development and implementation of the individual plan." | The home shall inform and explain individual rights and the process to report a rights violation to the individual, and persons designated by the individual, upon admission to the home and annually thereafter. | After receiving the licensing citation, Jami Residences completed a comprehensive review of its Individual Rights Statement to ensure alignment with 55 Pa. Code §§6400.31--6400.33.
The Individual Rights Statement was promptly updated to include the omitted right:
"An individual has the right to participate in the development and implementation of the individual plan."
The revised Individual Rights Statement was added to the agency's Individual Rights Acknowledgment process. Current individuals served will review and sign the updated statement, and all newly admitted individuals will receive it during admission. Signed acknowledgments will be maintained in each individual's record in accordance with Chapter 6400.
