6400.21(a)Staff #1, date of hire 5/2/13, had a criminal background check that was requested on 5/2/13. The background check was completed on 5/9/13 and contained prohibitive offenses in accordance the Older Adult Protective Services Act (35 P.S. § 10225.101¿10225.5102) and 6 Pa.Code Chapter 15 (relating to protective services for older adults). Staff #1 has worked unsupervised in the community homes during his/her employment from May, 2013 through October 11, 2013. (a) An application for a Pennsylvania criminal history record check shall be submitted to the State Police for prospective employees of the home who will have direct contact with individuals, including part-time and temporary staff persons who will have direct contact with individuals, within 5 working days after the person's date of hire. Site: 6400.21(a) The area of non-compliance will be brought into compliance by having the HR Department review all employee records (i.e. PA State Police check, Child Abuse Clearance, and FBI Fingerprint clearance) when received. If there are any discrepancies, the probationary employee will be taken off the schedule until the issue is resolved. Also, the HR Department will have the Fiscal Director review any criminal background checks that are in question. The HR Department will be responsible for this plan.
