6400.22(c)Individual's funds shall be used for the individual's benefits. Individual #1 is being charged the maximum amount of room and board allowed, per the current and previous Room and Board Residency Agreements, which is to be charged when the provider agency provides both the room and board, i.e. purchases the food for the individual. Individual #1, however, receives a substantial amount of SNAP benefits which are used each month to purchase the bulk of, if not all, the food consumed in the house. A review of the receipts for the month of March 2026 showed that the individual's food stamp benefits were used on 3/06/2026 at ALDI for a total purchase of $159.19 and on 3/28/2026 at LIDL for a total purchase of $179.40. Both purchases were for food only and all was covered by the individual's SNAP benefits. The items purchased were pantry and refrigerator staples such as vegetables, milk, cereal, meat, beans and bread which should be provided for by the Agency under the terms of the room and board contract. The practice of utilizing the individual's SNAP benefits to purchase all the household groceries could be seen going back through the EBT records, not just the month of March 2026 which was used for example. The provider is, therefore, overcharging the individual for Room and Board.Individual funds and property shall be used for the individual's benefit. Agency lower individual room and board to 40percent. Individual did not pay room and board from April 2025 -September 2025 due to family member misappropriation of social security funds. Individual #1's assessment dated 6/28/25 he is not poison safe, poisonous substances are kept locked. At the time of the inspection, located in the kitchen cabinet above the stove was two spray bottles of Great Value Morning Meadow Scent Disinfectant Spray, and the labels stated to call Poison Control Center.Poisonous materials shall be kept locked or made inaccessible to individuals.
