This violation occurred in July and we are unable to correct. Regardless, we will train all supervisory and management staff on 213 regulations, especially as it relates to 213(1) personal and identifying information being in the each file. This training will be completed by the program director, no later than 5/31/18. The Pertinent Information Sheet that is currently being used to capture this required information is being adjusted to bold regulatory requirements, so they are not inadvertently skipped or removed from the document again. 6400.33(e)Individual #1 was being audio monitored in the staff sleeping area through a baby monitor located on the dresser in Individual #1's bedroom.An individual has the right to privacy in bedrooms, bathrooms and during personal care. Individual #1¿s mother and legal guardian purchased and requested the use of the audio monitor at the home during sleeping hours. She did this based on safety concerns and conversations with her daughter¿s doctor. This individual¿s seizure activity is most often nocturnal. The individual also finds comfort in the monitor. The individual describes that she can physically sense seizures coming on and call out to staff. The individual understands the purpose of the monitor and will turn it on at night. She also has the ability to turn it off, if she so chooses. The use of the device was discussed at all team meetings and was documented in her ISP¿s and quarterlies. Until we became aware of the regulatory clarification from May of 2015 related to audio monitoring and since she wanted, purchased and could operate the device herself, we considered that her right, not an invasion of her privacy. To resolve the citation, we are currently collecting supporting documentation to accompany a ¿Request for Waiver of Regulation¿. We anticipate the request will be submitted to the Bureau no later than 6/15/16.[Waiver of 55 Pa.Code 6400.33e was granted on June 28, 2016. All conditions of the waiver shall be adhered to and monitored by the Program Specialist and reviewed by the Program Director at least quarterly. Documentation of reviews shall be kept. Within 60 days of receipt of the plan of correction all staff working in community homes shall be trained by the program director or designated staff person in individual's rights including the right to privacy in bedrooms, bathrooms and during personal care.
